АНАЛІЗ ПРОБЛЕМ ТА ПЕРСПЕКТИВ ДОГОВІРНО-ПРАВОВОГО ОФОРМЛЕННЯ МОРСЬКОЇ ДІЛЯНКИ ДЕРЖАВНОГО КОРДОНУ УКРАЇНИ ТА РОСІЙСЬКОЇ ФЕДЕРАЦІЇ
Анотація
У статті проведено аналіз проблем та перспектив переговорного процесу з питань делімітації морської ділянки українсько-російського державного кордону. Наголошено, що найбільш проблемним питанням зазначеного переговорного процесу є делімітація морського кордону з Росією, а також розмежування континентального шельфу та виключних (морських) економічних зон України та Російської Федерації у Чорному морі. Обгрунтовано, що відсутність делімітації морської ділянки українсько-російського державного кордону створює передумови до виникнення конфліктних ситуацій та прикордонних інцидентів. Доведено, що для розв'язання зазначеної проблеми необхідно звернутися до Міжнародного Суду ООН із проханням визначити лінію морської ділянки державного кордону між Україною і Російською Федерацією.

THE ANALYSIS OF PROBLEMS AND PROSPECTS CONTRACTUAL BASIS FOR THE OFFSHORE SECTION OF THE STATE BORDER OF UKRAINE AND RUSSIAN FEDERATION
Summary
In the article the analysis of problems and prospects of the negotiation process on the issues of delimitation of the Maritime section of the Ukrainian-Russian state border. Noted that the most problematic issue specified in the negotiation process is the delimitation of the Maritime border with Russia, as well as the delineation of the continental shelf and exclusive (marine) economic zone of Ukraine and the Russian Federation in the Black sea. It is substantiated that the lack of delimitation of the Maritime section of the Ukrainian-Russian state border, creates the prerequisites for the emergence of conflict situations, and frontier incidents. It is proved, that for the decision of this problem it is important to appeal to the international Court of justice with a request to determine the line of the offshore section of the state border between Ukraine and the Russian Federation.
