Анотація
На сучасному етапі в Україні прослідковується недосконалість та невідповідність законодавчого поля в галузі ефективного впровадження систем та програмам із енергозбереження, що негативно впливає як на стан промислових підприємств, так і на стан національної безпеки в цілому. У роботі проаналізовано законодавчо-нормативну базу України, з 1985 до 2014 року. Розглянуто найбільш важливі та дієві документи, які позитивно вплинули на розвиток енергозбереження на промислових підприємствах України. За роки незалежності України відбувся певний позитивний розвиток у напрямку запровадження та стимулювання системи енергозбереження. Проте, до сьогодні, відсутній механізм подальшої реалізації енергоефективної політики на підприємстві, відсутнє законодавче та нормативне підгрунтя для системного підходу до регулювання енергоефективності. Правове регулювання інституту енергоефективності та енергетичного сектору в цілому потребує подальшого законодавчого розвитку та систематизації.

LEGAL ASPECTS OF ENERGY SAVING IN UKRAINE
Summary
On this stage of development of Ukraine the imperfections and inadequacies in the legislative environment in the field of effective implementation of energy saving programs became visible, which negatively affects the industry and the national security. The main goal of this study is to provide analysis of evolution of legislation of Ukraine in the context of historical periods and development of the country in order to identify inconsistencies and gaps in the legislation. In this work we analyzed the legal and regulatory framework of Ukraine for the period of 1985—2014. We focused on the most important and effective documents which positively influenced the development of the energy efficiency of the industrial enterprises of Ukraine. Analysis of the legal framework of Ukraine in the field of energy saving demonstrates that at the initial phase of independence the Government of Ukraine highlighted comprehension of energy conservation and efficiency implementation in the industry.
Since our independence, Ukraine demonstrates positive development as for introduction and promotion of energy saving systems. At this time, Ukrainian government adopted the Law "On energy saving" and other normative documents that are mandatory or recommended for implementation by management of industrial enterprises. Successfully completed first steps concerning record-keeping of energy resources, implemented obligatory recording of energy passports, developed energy audit system. However, up-to-date, mechanism for further implementation of energy efficiency policies at the enterprise is not available; there is no legislative and regulatory basis for systematic approach concerning regulation of energy efficiency.
Legal regulation of energy efficiency in Ukraine requires substantial development of the legislation and its systematization. The results of this work will assist in formulation of the vector for development of energy saving and in coordination of producers' efforts in searching new management procedures that will contribute to the efficient use of energy resources.
