АНАЛІЗ ОСОБЛИВОСТЕЙ ТА ОБМЕЖЕНЬ У ЗДІЙСНЕННІ ДЕМОКРАТИЧНОГО ЦИВІЛЬНОГО КОНТРОЛЮ ЗА ДІЯЛЬНІСТЮ СЕКТОРУ БЕЗПЕКИ І ОБОРОНИ УКРАЇНИ
Анотація
У статті проведено аналіз особливостей та обмежень у здійсненні демократичного цивільного контролю за діяльністю сектору безпеки і оборони України. Встановлено, що чинним законодавством визначено особливості та обмеження у здійсненні демократичного цивільного контролю над сектором безпеки і оборони України, зокрема у ст. 7 Закону України "Про демократичний цивільний контроль над Воєнною організацією та правоохоронними органами держави". Розкрито детально норми статті з огляду на їх застосування в практичній площині. Зазначено, що специфіка роботи оперативних підрозділів пов'язана з використанням спеціальних форм та методів, більшість з яких становить державну таємницю з міркувань захисту національних інтересів та забезпечення державної безпеки.

Summary
In the article the analysis of characteristics and constraints in the implementation of democratic civilian control over the security sector and defense of Ukraine. It is established that the current legislation defined the characteristics and limitations in the implementation of democratic civilian control over the security sector and defense of Ukraine, in particular in article 7 of the Law of Ukraine "On democratic civil control over Military organization and law enforcement agencies of the state" Disclosed the details of the provisions of this article with regard to their application in a practical way. Note that the specific operational units associated with the use of special forms and methods, most of which is protected by state secret for reasons of protection of national interests and national security.
