ЗАКОНОДАВЧО-ІНСТИТУЦІЙНІ ЗАСАДИ ФОРМУВАННЯ ТА РЕАЛІЗАЦІЇ ДЕРЖАВНОЇ ПОЛІТИКИ У СФЕРІ ЗЕМЕЛЬНИХ ВІДНОСИН УКРАЇНИ
Анотація
У статті зазначено, що досягнення вагомих успіхів у розвитку і удосконаленні сфери земельних відносин, забезпечення високої ефективності та якості процесів формування та реалізації державної політики, здійснення державного управління на рівні світових стандартів не можливе без законодавчо-інституційного забезпечення цих процесів. Наголошено, що вдосконалення системи управління земельними відносинами необхідно здійснити через створення єдиного державного органу з управління земельними ресурсами у вигляді багатофункціонального і структурно складного об'єкту де складовими частинами мають виступати агентство з управління землями державної власності, агентство з охорони навколишнього природнього середовища, екологічна інспекція, інспекція з використання та охорони земель усіх категорій та форм власності, департамент державного кадастру і реєстрації прав на землю. Розкрито зміст категорій "законодавчо-інституційні засади", "функції державного управління сферою земельних відносин в Україні" та "система державного управління сферою земельних відносин". Зазначено, що система державного управління сферою земельних відносин характеризується складною архітектонікою організаційної структури, складними взаємозв'язками управлінських процесів між її ланками (підсистемами), наявністю широкого кола управлінських функцій, які в залежності від управлінського рівня, сфери предметної діяльності органів законодавчої та виконавчої влади можна класифікувати та згрупувати за ознаками процесуальної спрямованості регулюючих впливів (законотворча, політико-формуюча, регулятивне-погоджувальна, реалізаційне-розпорядча, координаційна, організаційна, контролююча, інформаційна), повноваженнями щодо формування та реалізації державної політики органами державної влади в сфері земельних відносин.

LEGISLATIVE AND INSTITUTIONAL BASES FOR FORMATION AND REALIZATION OF STATE POLICIES IN THE LAND RELATIONS OF UKRAINE
Summary
The article states that achievement of significant successes in the development and improvement of the sphere of land relations, ensuring high efficiency and quality of the processes of formation and implementation of state policy, implementation of state management at the level of world standards is impossible without legislative and institutional support of these processes. It was emphasized that the improvement of the land management system should be implemented through the creation of a unified state body for managing land resources in the form of a multifunctional and structurally complex object, where the constituent parts should be the State Property Management Agency, the Environmental Protection Agency, the Environmental Inspection, Inspection on use and protection of land of all categories and forms of ownership, Department of state cadastre and registration of rights to the emblem The content of the categories "legislative and institutional foundations", "functions of state administration in the field of land relations in Ukraine" and "system of state administration in the sphere of land relations" are revealed. It is noted that the system of public administration in the sphere of land relations is characterized by complex architectonics of the organizational structure, complex interconnections of management processes between its units (subsystems), the presence of a wide range of managerial functions, which, depending on the managerial level, the scope of the substantive activity of the legislative and executive bodies can be classified and grouped according to the procedural orientation of regulatory influences (legislative, politico-forming, regulatory-concerted, re organizational, regulatory, coordination, organizational, controlling, informational), authorities regarding the formation and implementation of state policy by state authorities in the field of land relations.
