ПОНЯТТЯ ОРГАНІЗАЦІЙНО-ПРАВОВОГО АСПЕКТУ ДЕЛЕГУВАННЯ ПОВНОВАЖЕНЬ У СИСТЕМІ ОРГАНІВ МІСЦЕВОГО САМОВРЯДУВАННЯ В УКРАЇНІ
Анотація
Статтю присвячено теоретичним проблемам визначення сутності поняття організаційно-правового аспекту делегування повноважень у системі органів місцевого самоврядування. Розкрито зміст організаційної та правової складової наведеного поняття, оскільки здійснення переходу від теоретичної категорії "аспект" до поняття організаційно-правовий аспект делегування повноважень у системі місцевого самоврядування дозволяє у структурі організаційно-правового аспекту виокремити дві складові: правову як сукупність норма права, що регулюють делегування повноважень у системі місцевого самоврядування та організаційну як сукупність інституцій й організаційних дій (процедур). Досліджено сутність "організаційно-правового аспекту" як окремої категорії державного управління. Визначено проблемні моменти й особливості правового регулювання та організаційно забезпечення процесу делегування в системі місцевого самоврядування.

CONCEPT OF ORGANIZATIONAL AND LEGAL ASPECT OF DELEGATION OF POWERS IN THE SYSTEM OF LOCAL SELF-GOVERNMENT BODIES IN UKRAINE
Summary
The research paper deals with the theoretical problems of determination of the essence of the concept of organizational and legal aspect of delegation of powers in the system of local self-government bodies. The research objective is to analyze the theoretical and methodological principles of the organizational and legal aspect of delegation of powers in the system of local self-government bodies in Ukraine. The content of the organizational and legal component of the given concept is revealed. The essence of the "organizational and legal aspect" as a separate category of administrative law is explored. The problem points and peculiarities of organizational support for the delegation process in the system of local self-government are determined. It is noted that the organizational and legal aspect of delegation of powers in the system of local self-government bodies includes a set of elements of the organizational, functional, regulatory component of the administrative activity of the subjects of the delegation relations, and are provided by external conditions — the legal environment. It was pointed out that the organizational and legal aspect of delegation of powers in the field of local self-government reveals a number of principles that underpin the expediency of choosing a delegation model. Such principles may include: the principle of rational distribution and use of resources and efforts to fulfil a certain function; the principle of complexity, which involves simultaneous contractual formalization of the delegation of powers with the transfer of material and technical potential for their practical implementation; the principle of purposefulness manifested through the vision of the ultimate goal, which is achieved by the local self-government body to which the powers were delegated. It was stated that the organizational and legal aspect of delegation of powers allows practical implementation of the theoretical concept of delegation relations under the condition of determination of the conditions and mechanisms for the implementation of such relations, and this involves the conclusion of the relevant agreement or the development of a different form of legitimizing the relations between non-subordinated public authorities.
