ЕВОЛЮЦІЯ ВИБОРЧОГО ЗАКОНОДАВСТВА ЯК ОСНОВИ ФОРМУВАННЯ ПРЕДСТАВНИЦЬКОЇ ВЛАДИ НА МІСЦЕВОМУ РІВНІ
Анотація
У статті зазначено, що вибори є однією із форм безпосередньої участі громадян в управлінні державою шляхом формування вищих представницьких органів, органів місцевого самоврядування та їх персонального складу. Метою статті є дослідження еволюції законодавчого забезпечення однієї з форм безпосередньої демократії — виборів, як основи формування представницької влади на місцевому рівні. Доведено, що місцеві вибори в Україні, а також практика реалізації чинного законодавства про місцеві вибори постійно привертають увагу науковців і практиків.
Зауважено, що інститут виборів в Україні, і місцевих виборів зокрема, пройшов значний в історичному вимірі і складний за суспільним розвитком шлях. Протягом років незалежності в Україні місцеві вибори проводилися в 1994, 1998, 2002, 2006, 2010, 2015 рр. Обгрунтовано, що за цей час неодноразово змінювалося законодавство про вибори, у тому числі види виборчих систем. Дотепер у законодавстві про місцеві вибори є багато недоліків і прогалин, нагальною необхідністю є створення ефективного механізму, який забезпечив би своєчасне самооновлення політичної системи з урахуванням мінливих внутрішніх та міжнародних умов, запровадження в усі сфери життя принципів демократії та самоврядування.

EVOLUTION OF ELECTORAL LEGISLATION AS THE BASIS OF FORMATION OF THE REPRESENTATIVE AUTHORITY AT LOCAL LEVEL
Summary
The article states that elections are one of the forms of direct participation of citizens in the management of the state through the formation of higher representative bodies, bodies of local self-government and their personal composition. The purpose of the article is to study the evolution of legislative provision of one of the forms of direct democracy — elections, as the basis for the formation of representative power at the local level. It is proved that the local elections in Ukraine, as well as the practice of implementing the current legislation on local elections, constantly attract the attention of scholars and practitioners.
It is noted that the institution of elections in Ukraine, and local elections in particular, has undergone a significant historical and social development path, which created the preconditions for the formation of truly democratic local elections in Ukraine. During the years of independence in Ukraine, local elections were held in 1994, 1998, 2002, 2006, 2010, 2015. It is substantiated that during this time the legislation on elections, including types of electoral systems, has been repeatedly changed.
Assessing the current state of the institute of local elections in Ukraine, it should be noted that it mainly meets the generally accepted world standards and requirements, takes into account the historical experience of local self-government development in Ukraine, but at the same time, the practice revealed weaknesses, certain gaps in legislation on local elections. Some of them have already found a legislative settlement, but there are still many unresolved issues, the presence of which causes some complications in the implementation of this form of direct democracy. To date, the legislation on local elections has many shortcomings and gaps; the urgent need is to create an effective mechanism that would ensure the timely self-renewal of the political system, taking into account changing internal and international conditions, the introduction of the principles of democracy and self-government in all spheres of life.
It is noted that the repeatedly authoritative international organizations, in particular the Venice Commission, scientists and practitioners raised the question of the codification of the electoral legislation of Ukraine, which would help to unify the election procedures of presidential, parliamentary and local elections. Such a legislative act would help to establish uniform procedures in the elections, would make it impossible to change the electoral norms during the electoral process in Ukraine. However, today this question remains unresolved.
