МІЖНАРОДНИЙ ДОСВІД ЕФЕКТИВНОЇ ВЗАЄМОДІЇ ДЕРЖАВИ І ГРОМАДЯНСЬКОГО СУСПІЛЬСТВА ТА ЙОГО ІМПЛЕМЕНТАЦІЯ В ПРАКТИКУ ДЕРЖАВНОГО УПРАВЛІННЯ УКРАЇНИ
Анотація
У статті здійснено грунтовний аналіз взаємодії держави та громадянського суспільства в умовах децентралізації. Обгрунтовано питання, що важливим чинником побудови нової держави, основаної на демократичних цінностях у період трансформаційних процесів, особливо при переході від тоталітарної форми правління до демократії, є вивчення та впровадження ефективних моделей зарубіжного досвіду.
Відповідно до поставленої дослідницької мети розкрито теоретико-методологічний зміст імплементації міжнародного досвіду щодо взаємодії держави і громадянського суспільства в умовах децентралізації в Україні. Заслуговує на увагу сформульоване у статті бачення, що процес формування громадянського суспільства в Україні безпосередньо залежить від правового визначення статусу його інститутів і зокрема максимально ефективного законодавчого закріплення скоординованого порядку створення та діяльності громадських організацій. Законодавче регулювання має базуватися на достатньо виваженому, розумному балансі інтересів держави і громадянського суспільства. Ідентифіковано критерії ефективності механізмів державного управління у взаємодії органів державної влади з громадянським суспільством. З'ясовано, що від масштабів державного втручання у діяльність об'єднань громадян залежить державний режим і напрями подальшого розвитку держави.

INTERNATIONAL EXPERIENCE OF THE EFFECTIVE INTERACTION OF THE STATE AND CIVIL SOCIETY AND ITS IMPLEMENTATION IN THE PRACTICE OF THE STATE ADMINISTRATION OF UKRAINE
Summary
The article provides a thorough analysis of the interaction of state and civil society in the conditions of decentralization. The article argues that the study of effective models of foreign experience is an important factor in the construction of a new state based on democratic values during the period of transformational processes, especially in the transition from a totalitarian form of government to democracy.
According to the research goal, the theoretical and methodological content of the implementation of international experience concerning the interaction of the state and civil society in the conditions of decentralization in Ukraine is disclosed. The article formulated in the article that the process of forming a civil society in Ukraine directly depends on the legal definition of the status of its institutions and, in particular, on the maximum effective legislative consolidation of a coordinated procedure for the creation and operation of public organizations. Legislative regulation should be based on a sufficiently balanced, reasonable balance of interests of the state and civil society. The criteria of the effectiveness of public administration mechanisms in the interaction of public authorities with civil society have been identified. It was clarified that the state regime and directions of further development of the state depend on the extent of state interference in the activities of citizens' associations. It has been discovered that over the last decades the idea of civil society has been gradually evolving, changing the views of citizens and government officials on its role and added value. For many years, governments around the world have seen an obstacle in civil society organizations, which was more likely to interfere with the work of the authorities than to have any effect on its benefit. The gradual change of view towards the realization that CSOs in fact are indispensable and valuable partners of the authorities has led to the need to stop the decline of confidence in state institutions and overcome the widening gap between citizens and their authorities. The need for a constructive dialogue between citizens and institutions of governance and the provision of a more transparent, open and accountable management that responsibly responds to the needs of its citizens has formed a contemporary global awareness of the role of public dialogue in the decision-making process. The core of this new concept was the need to develop participatory democracy and responsible governance, which would support and support each other.
