МЕХАНІЗМИ ЗДІЙСНЕННЯ ГРОМАДСЬКОГО КОНТРОЛЮ ЗА ДОТРИМАННЯМ ПРАВ ДИТИНИ В ЗАКЛАДАХ ІНСТИТУЦІЙНОГО ДОГЛЯДУ ТА ВИХОВАННЯ ДІТЕЙ
Анотація
У статті обгрунтовується актуальність дослідження механізмів здійснення громадського контролю за дотримання прав дитини в закладах інституційного догляду та виховання дітей. Наголошено, що попередні дві спроби реформування сфери інституційного догляду та виховання в результаті дещо привернули увагу громадськості та органів державної влади щодо неефективності інституційного виховання дітей, проте не змогли подолати опору з боку працівників сфери та докорінно змінити погляди щодо соціального захисту і захисту прав дітей, які виховуються у закладах інституційного догляду та виховання. У статті зазначено, що реформа деінституалізації розпочалась із введення в дію Національної стратегії реформування системи інституційного догляду та виховання дітей на 2017—2026 роки і знаходиться лише на початку реалізації, вважаємо за потрібне посилити контроль за дотриманням прав та інтересів дітей, що перебувають на утриманні у закладах інституційного догляду та виховання в перехідний період шляхом запровадження громадського контролю. Запропоновано механізми здійснення громадського контролю за дотриманням прав дитини в закладах інституційного догляду та виховання дітей в Україні, що спрямовані на захист та забезпечення прав і законних інтересів дитини в закладах інституційного догляду та виховання.

MECHANISMS OF IMPLEMENTATION OF PUBLIC CONTROL FOR IMPLEMENTATION OF CHILD RIGHTS IN THE INSTITUTIONAL CARE AND CHILDREN'S INSTITUTIONS
Summary
The article substantiates the relevance of the study of mechanisms for the implementation of public control over the observance of the rights of the child in institutions of institutional care and upbringing of children. It was emphasized that the previous two attempts to reform institutional care and education resulted in some attention of the public and the authorities on the ineffectiveness of institutional education of children, but failed to overcome the resistance of the workers of the sphere and radically change the views on social protection and the protection of the rights of children who are educated in institutions of institutional care and education. The article states that the reform of deinstitutionalisation began with the introduction of the National Strategy for the reform of the institutional care and upbringing of children for 2017—2026, and is only at the beginning of the implementation; we consider it necessary to strengthen the control over the observance of the rights and interests of children in dependence on Institutions for institutional care and education in a transitional period through the introduction of public control. The mechanisms for implementing public control over the observance of the rights of the child in institutions of institutional care and upbringing of children in Ukraine aimed at protecting and ensuring the rights and legitimate interests of the child in institutions of institutional care and upbringing are proposed: ensuring transparency and control over the activities of executive authorities and local self-government bodies, whose competence includes institutional care and education of children in Ukraine; promotion of interaction between executive authorities and local self-government bodies with public associations and other civil society institutions on issues related to the activities of institutional care and education institutions; promotion of consideration by public authorities of public opinion during the reform of the system of institutional care and upbringing of children in Ukraine.
