СВІТОВИЙ ДОСВІД ПРАВОВОГО РЕГУЛЮВАННЯ МІСЦЕВИХ ВИБОРІВ

Анотація

У статті зазначено, що наявність повноцінного місцевого самоврядування, через яке найповніше може бути реалізовано ідею здійснення влади народом безпосередньо, є однією з визначальних ознак демократичної, соціальної та правової держави. За останні роки в умовах децентралізації відбулися зміни в суспільно-політичному устрої України, що спричинили також значні зміни в законодавстві про місцеві вибори, але й дотепер у цьому питанні є багато недоліків, а першочерговою необхідністю є створення ефективного організаційно-правового механізму, який забезпечив би своєчасне самооновлення політичної системи з урахуванням змін, запровадження в усі сфери життя принципів демократизації суспільства.
Зазначено, що в різних країнах світу місцеві вибори відрізняються низкою особливостей: ступенем інтеграції із системою загальнонаціональних виборів; наявністю виборчих цензів; періодичністю проведення виборів; способом визначення кількості депутатів; особливостями формування виборчих округів; типом виборчої системи; способом обрання мерів або голів місцевих рад. Отже, на підставі аналізу місцевих виборів у зарубіжних країнах можна зробити висновок про те, що Україна прагне наблизитись до європейських стандартів у сфері виборчого права. Водночас пропорційна виборча система на місцевих виборах потребує подальшого вдосконалення. Під час формування органів місцевого самоврядування в Україні, запозичивши зарубіжний досвід, необхідно: завершити реформу адміністративно-територіального устрою країни, прийнявши ряд законодавчих і нормативно-правових актів, сформувати самодостатні органи місцевого самоврядування, провівши чергові місцеві вибори на новій законодавчій основі.

WORLD EXPERIENCE OF LEGAL REGULATION OF LOCAL ELECTIONS

Summary

The article states that the existence of full-fledged local self-government, through which the idea of exercising power directly by the people can be fully implemented, is one of the defining features of a democratic, social and rule of law. In recent years, changes in the social and political system of Ukraine have taken place in the conditions of decentralization, which have also led to significant changes in the legislation on local elections, but so far there are many shortcomings in this matter, and the urgent need is to create an effective legal and legal mechanism that would provide timely self-renewal of the political system in the light of changes, implementation of the principles of democratization in all spheres of life.
Attention is drawn to the fact that the issue of creating the proper conditions for the implementation of the constitutional right of citizens to freely choose and be elected, in particular, to local self-government bodies is a priority. Therefore, the exceptional importance of local elections for the development of local self-government and direct democracy in Ukraine, testify to the relevance of this topic, determine not only the scientific but also the practical importance, in particular, to improve the legislation of Ukraine on local elections by introducing the best features of the world experience in the development of the institute local elections.
Democratic elections are proven to be a complex and multidimensional process that involves a wide range of components, functions, tools, principles and properties. Some of them are the constancy and equality of the rules of the game for all, competitiveness, the rule of law, civil society, freedom of speech, independent court and more. These and many other components in their interaction ensure the relative effectiveness of elections as an institution. For almost two decades, every election in Ukraine has been held under the new law. The Laws of Ukraine "On the election of the People's Deputies of Ukraine" and "On the local elections state that the participation of Ukrainian citizens in the elections of deputies is voluntary. No one shall be compelled to participate in or not participate in elections.
It is noted that in different countries, local elections are distinguished by a number of features: the degree of integration with the system of national elections; availability of electoral qualifications; the frequency of elections; the method of determining the number of deputies; features of constituency formation; the type of electoral system; a way to elect mayors or heads of local councils. Therefore, based on the analysis of local elections in foreign countries, we can conclude that Ukraine is seeking to move closer to European standards in the field of suffrage. At the same time, the proportional election system in local elections needs further improvement. During the formation of local self-government bodies in Ukraine, borrowing from foreign experience, it is necessary to: reform the administrative-territorial system, adopt a number of legislative and regulatory acts, form self-sufficient local self-government bodies, and hold regular local elections on a new legislative basis.
