ОРГАНІЗАЦІЙНО-ПРАВОВИЙ МЕХАНІЗМ ДЕРЖАВНО-УПРАВЛІНСЬКОГО ВПЛИВУ: ЗМІСТ ТА ХАРАКТЕРИСТИКА КАТЕГОРІЇ
Анотація
За результатами аналізу існуючих у межах наукового дискурсу тлумачень дефініції "організаційно-правовий механізм державного управління" було виокремлено квінтесенцію їх категоріального змісту. Стаття містить узагальнення щодо особливостей прояву дуальності змісту організаційно-правовий механізму в контексті реалізації суб'єктом публічного управління функцій державного управління та державного регулювання. В статті обгрунтовано необхідність зміни змістовних акцентів під час формулювання дефініції організаційно-правового механізму з "державного управління" та "державного регулювання" на "державно-управлінський вплив". У статті запропоновано авторський погляд щодо переліку та змісту основних складових організаційно-правового механізму державно-управлінського впливу, а саме: мета, завдання та методи; функції, принципи та ресурси органів влади; система норм та правил; система органів влади; середовище, умови та фактори впливу. В статті наведено авторське тлумачення категоріального змісту дефініції організаційно-правового механізму державно-управлінського впливу та розглянуто його універсальну та функціональну складові.

ORGANIZATIONAL AND LEGAL MECHANISM OF PUBLIC ADMINISTRATIONAL INFLUENCE: CONTENT AND CHARACTERISTICS OF THE CATEGORY
Summary
Content analysis of the researches held in the framework of the sphere of the "Public management and administration" science have found that the authors freely and not always reasonable use the definitions of organizational-legal, administrative-legal, informative-legal and normative-legal mechanisms of state administration and regulation. Quite often, especially young scientists, equate not only relative definitions, but also their content. Such inattention in the usage of scientific definitions does not only distort their categorical meaning, but also negatively affects the credibility of the results obtained by the scientists. Paper objective. To advice the author's approach to the interpretation of the organizational-legal mechanism of the public administration influence basing on the results of the analysis of the theoretical and methodical basics as for the sense and peculiarities of its functioning. Paper main body. According to the results of the analysis of the interpretations of the existing within the framework of the scientific discourse definition " organizational-legal mechanism of public administration", the quintessence of their categorical meaning was identified. The obtained results made it possible to formulate summaries about the duality of the manifestation of the content of the organizational-legal mechanism in the context of the implementation of the functions of management and regulation by public authorities. Such step gave us an opportunity to formulate the assumption about the need to change the sense emphasis in the definition of the category of organizational-legal mechanism from "public administration" and "state regulation" into "state-administrative influence". The essence of the organizational and legal mechanism of the public administration influence can be disclosed through the dialectical unity and sense of such constituent elements as: purpose, objectives and methods; functions, principles and resources of authorities; the system of rules and regulations; the system of authorities; environment, conditions and the influencing factors. The article proposes the substantive content of each of these elements, with taking into account the main characteristics of the organizational and legal mechanism of the public administration influence. Conclusions of the research. Under the organizational-legal mechanism of the public administration influence we should understand dialectically conditioned by the unity of purpose, tasks, functions and principles controlling influence of the subjects of public administration with such methods, means, tools and technologies of targeted impact, the nature of the origin and usage of which, on the one hand, is connected with the creation of legal and regulatory acts and the system of ensuring their execution, and on the other hand — with the development (improvement) of the system and structure of administration and formation in the framework of its effective professional hierarchical communications (systems of interdependence between the goals of influence on the object of direct attention and interaction between participants of the its transferring process to a new state).
