ФОРМУВАННЯ МЕХАНІЗМУ АДАПТАЦІЇ СОЦІАЛЬНОГО ЗАХИСТУ ДО ЄВРОПЕЙСЬКИХ СТАНДАРТІВ
Анотація
Зазначено, що складний механізм інституційних органів, який складався в новітній історії ЄС і відточувався протягом майже півстоліття, забезпечує соціальне й економічне згуртування Співтовариства та вирішення питань, що стосуються соціальної політики та інтеграції в цій сфері. У структурі інститутів ЄС, пов'язаних із соціальним виміром, за останні роки позначилося чимало змін. Нові завдання, що постали перед соціальною політикою в зв'язку з розвитком інтеграції в соціальній сфері та глобалізацією, природно, вимагали вдосконалення механізму виконавчої влади, збільшення її компетенцій або створення нових структур, здатних конструктивно відповісти на виклики часу. Необхідність же забезпечення ефективності їх роботи передбачала наявність відповідної законодавчої бази.
Визначено, що збільшення повноважень інститутів ЄС вносить позитивний внесок у розвиток права Співтовариства в соціальній сфері. Величезну роль відіграє еволюція процедур, зокрема, розширення можливості приймати рішення кваліфікованою більшістю, введене Єдиним європейським актом і підтверджене протоколом до Договору про Європейський Союз, а також визнання значущості європейських колективних договорів. Система комунітарних інститутів, що працюють у соціальній сфері, а також встановлені процедури прийняття соціальних документів, безумовно, є інструментами будівництва соціальної Європи. Основною діючою особою і співрозмовником серед інститутів, що працюють у соціальній сфері є Рада з соціальних питань. Іноді в залежності від обстановки вона збирає по кілька разів на тиждень компетентних міністрів держав-членів. При цьому їй належить право приймати рішення далеко не за всіма соціальними питаннями. Так, проблеми охорони здоров'я знаходяться в компетенції Ради з охорони здоров'я і Ради у справах внутрішнього ринку. Саме з їх ініціативи можуть припинятися або видозмінюватися дії відповідних директив і рішень.

FORMATION OF THE MECHANISM OF ADAPTATION OF SOCIAL PROTECTION TO EUROPEAN STANDARDS
Summary
It is noted that the complex mechanism of institutional bodies, developed in the recent history of the EU and refined for almost half a century, provides social and economic cohesion of the Community and resolves issues related to social policy and integration in this field. There have been many changes in the structure of EU institutions related to the social dimension in recent years. The new challenges facing social policy in relation to the development of social integration and globalization, of course, required the improvement of the mechanism of the executive power, the increase of its competencies or the creation of new structures that can respond constructively to the challenges of the times. The need to ensure the effectiveness of their work provided for the existence of an appropriate legal framework.
It is determined that the enhancement of the powers of the EU institutions contributes positively to the development of Community law in the social field. The evolution of procedures, in particular, the empowerment of qualified majority decisions introduced by the Single European Act and confirmed by the protocol to the Treaty on European Union, and the recognition of the importance of European collective agreements, play a huge role. The system of communal institutions operating in the social sphere, as well as the established procedures for adopting social documents, are certainly tools for building a social Europe. The main actor and interlocutor among the institutions working in the social sphere is the Social Affairs Council. Sometimes, depending on the situation, it collects several times a week the competent ministers of the Member States. At the same time she has the right to make decisions not on all social issues. Yes, health issues fall within the competence of the Health Council and the Internal Market Council. It is on their own initiative that the relevant directives and decisions may be suspended or modified.
