ГРОМАДСЬКА ЕКСПЕРТИЗА ПРОЄКТІВ ТА ЧИННИХ НОРМАТИВНО-ПРАВОВИХ АКТІВ ОРГАНІВ ПУБЛІЧНОГО УПРАВЛІННЯ УКРАЇНИ ЯК ЗАСІБ ЗАБЕЗПЕЧЕННЯ ЇХ ЕФЕКТИВНОСТІ
Анотація
У статті здійснено теоретичне обгрунтування сутності, видів громадських експертиз як засобу забезпечення ефективності чинних та проєктів нормативно-правових. Виокремлено об'єкти та суб'єктів проведення громадських експертиз. Визначено проблеми застосування громадської антикорупційної, громадської антидискримінаційної експертиз на практиці та запропоновано шляхи їх вирішення. Здійснено порівняння правової природи додаткової громадської антикорупційної, антидискримінаційної експертиз з офіційними експертизами, які проводяться органами державної влади. Досліджено форми проведення консультацій з громадськістю (публічне громадське обговорення, електронні консультації з громадськістю (безпосередні форми) та вивчення громадської думки (опосередкована форма), їх реалізацію на практиці. Запропоновано закріпити у нормативно-правових актах визначення понять: "громадська антикорупційна експертиза", "громадська антидискримінаційна експертиза". Окреслено доцільність активізації процесу проведення громадської антикорупційної, громадської антидискримінаційної експертиз.

PUBLIC APPRAISALS OF PROJECTS AND CURRENT LEGAL ACTS OF PUBLIC ADMINISTRATION BODIES OF UKRAINE AS AN INSTRUMENT FOR THEIR EFFECTIVENESS PROVISION
Summary
The article provides a theoretical substantiation of the essence, types of public appraisals as a means of ensuring the effectiveness of current and projects legal acts. The objects and subjects of conducting public appraisals are highlighted (the entity of public expertise, including in the context of assessing the legal acts effectiveness, is civil society; the object of these appraisals can be defined as the public administration bodies' projects and legal acts).
The problems of applying the public anti-corruption, public anti-discrimination appraisals in practice are identified and the ways of their solution are proposed. The problematic issues of conducting public anti-corruption expertise, in our opinion, include the following ones: the lack of an up-to-date version of the project government act in online access for representatives of civil society, considering the fact that its content is constantly changing; lack of a unified methodology for conducting public anti-corruption expertise; the absence of a formal requirement for the obligatory publication of the public anti-corruption appraisals results.
Comparison of the legal nature of additional public anti-corruption, anti-discrimination appraisals with the official ones, which are carried out by state authorities, is realized. The forms of consultations with the public (public civil discussion, electronic consultations with the public (direct forms) and the public opinion study (indirect form) and their implementation in practice have been investigated. There have been proposed to formalize in legal acts the definitions of the following concepts: "public anti-corruption expertise", "public anti-discrimination expertise". The expediency of activating the process of conducting public anti-corruption and public anti-discrimination appraisals has been determined.
Public examination of projects and current legal acts should be understood as a formally conditioned assessment of these acts by civil society institutions for their compliance with public necessities and legislative requirements, and the provision of appropriate proposals for their improvement.
In order to assess the effectiveness of projects and current legal acts, public authorities and civil society should be interested in applying public anti-corruption, public anti-discrimination appraisals and those of the executive authorities' activities. At the same time, as evidenced by the information from the "Civil Society and Power" website, the level of public use of these assessment tools, including the public authorities acts effectiveness, is rather low or there is no information about its use at all.
With a view to implementing more actively the public appraisals and public assessment of the public administration bodies' activities by the society, within the framework of which their acts effectiveness is evaluated, it is advisable to amend the current legislation in terms of approval of methodological recommendations for conducting these appraisals and considering their results by public administration bodies, ensuring the promulgation of all versions of public administration bodies' projects legal acts or only the final one, which will be submitted to a vote (by the Cabinet of Ministers of Ukraine, the relevant council) or to be signed by the head of the Central Bodie of the Executive Authority or by the head of the local state administration; ensuring the publication of the appraisal results together with the project act.
The feasibility of activating the public appraisals conduction process has resulted from the need to increase the efficiency of public authorities acts, and, in turn, it would also contribute to the "public authority" — "civil society" dialogue, strengthening public confidence in the entities of power that may become the subject of further scientific research.
