ЦИВІЛЬНИЙ ЗАХИСТ УКРАЇНИ ЯК ФУНКЦІЯ ДЕРЖАВИ

Анотація

Проведено аналіз існуючих визначень функцій держави, що наведено в науковій літературі, запропоновано уточнене визначення поняття "цивільний захист".
Виявлено недоліки у законодавстві щодо визначення цивільного захисту як функції держави, що полягають, насамперед, у невизначеності функції держави в умовах збройного конфлікту та забезпечення захисту населення і територій від наслідків надзвичайних ситуацій в зазначених умовах.
Порушено проблему, сутність якої полягає у тому, що існуюче визначення функції держави щодо цивільного захисту не у повній мірі відповідає сучасним реаліям життєдіяльності нашого суспільства та не відображає усієї сукупності заходів, що має виконувати держава для забезпечення безпеки її громадян.
Запропоновано авторське визначення поняття "цивільний захист", а також вважати критерієм оцінювання функцій держави результати діяльності її інститутів, умову, коли реалізація її функції повною мірою відповідає об'єктивним потребам суспільства.

CIVIL DEFENSE OF UKRAINE AS A FUNCTION OF THE STATE

Summary

The analysis of existing definitions of the functions of the state, which is given in the scientific literature, provides a more precise definition of the concept of "civil defense".
The shortcomings in the legislation on the definition of civil protection as a function of the state are found, first of all, in the uncertainty of the state function in the conditions of an armed conflict and the protection of the population and territories from the consequences of emergencies in the specified conditions.
There is a problem, the essence of which is that the current definition of the state's function in relation to civil protection does not fully correspond to the current realities of the life of our society and does not reflect the whole set of measures that the state must perform to ensure the security of its citizens.
The author proposes the definition of the concept of "civil protection", as well as to consider the criteria for evaluating the functions of the state, the results of the activities of its institutions, a condition where the realization of its functions fully corresponds to the objective needs of society.
