СВІТОВИЙ ДОСВІД КОНСОЛІДАЦІЇ ЗЕМЕЛЬНИХ ПАЇВ

Анотація

У статті проаналізовано світовий досвід консолідації земельних паїв, призначення, передумови, тривалість консолідації земель у різних країнах світу. Описані найпопулярніші та найпоширеніші методи консолідації земельних паїв у світі. З'ясовано, що консолідація земельних паїв агрохолдингами є особливою формою консолідації земель зі своїми позитивними та негативними сторонами. Позитивним наслідком є підвищення рівня капіталізації сільськогосподарського виробництва, негативним — посилення монополізму на ринку оренди землі та витіснення традиційних форм аграрного підприємництва. Обов'язковим є формування комплексу регуляторних норм щодо концентрації земельної власності у підприємницьких формуваннях такого типу. Відсутність нормування може призвести до зростання екологічних і соціальних негараздів у використанні земельних паїв та спровокувати появу кризових явищ у сільському господарстві. З'ясовано, що сьогодні відсутність відповідного законодавства в Україні є перешкодою для здійснити консолідації земель і визначено необхідність запозичення світового досвіду консолідації земель для його використання в Україні, адже виходячи зі світового досвіду, консолідація земель є дуже ефективним засобом розвитку земель сільськогосподарського призначення, який відкриває перед землекористувачами та землевласниками більше можливостей для покращення ефективності землекористування та землеволодіння.

WORLD EXPERIENCE OF CONSOLIDATION OF LAND SHARES

Summary

To date, work in the field of agriculture is very popular. The whole world knows about the most fertile Ukrainian black earth. But, unfortunately, the conditions of farming on the ground deteriorate and will worsen until the existing problems are resolved through the implementation of projects and programs of integrated development of rural areas. Unfortunately, for the introduction of effective production in our country there are no large masses of land formed due to the dissection of former state farms and collective farms. Therefore, it is necessary to introduce the consolidation of land parcels on the territory of Ukraine on the example of the experience of foreign countries. Consolidation of land — formation of large arrays (fields) for improving the structure, composition of land, configuration and size of land plots of agricultural land holdings and land use. The article analyzes the world experience of consolidation of land shares, purpose, preconditions, duration of consolidation of land in different countries of the world. The most popular and most common methods of consolidation of land shares in the world are described. It was clarified that consolidation of land shares by agroholdings is a special form of consolidation of lands with its positive and negative sides. The positive consequence is an increase in the level of capitalization of agricultural production, a negative — the strengthening of monopoly in the market of lease of land and the displacement of traditional forms of agrarian entrepreneurship. It is imperative to form a complex of regulatory norms regarding the concentration of land ownership in business entities of this type. Lack of normalization can lead to an increase in environmental and social disadvantages in the use of land shares and to provoke the emergence of crisis phenomena in agriculture. It is found out that today the absence of the relevant legislation in Ukraine is an obstacle to land consolidation and the necessity of borrowing from the world experience of land consolidation for its use in Ukraine is determined, because, based on world experience, consolidation of land is a very effective means of development of agricultural land that opens Landlords and landowners have more opportunities to improve land-use and land-use efficiency.
