АНАЛІЗ ЗАКОНОДАВЧОГО МЕХАНІЗМУ УПРАВЛІННЯ ПРОЦЕСОМ ПУБЛІЧНИХ ЗАКУПІВЕЛЬ У РАМКАХ ІМПЛЕМЕНТАЦІЇ ЗАКОНОДАВСТВА ЄС У СФЕРІ ПУБЛІЧНИХ ЗАКУПІВЕЛЬ ДО УКРАЇНСЬКОГО ЗАКОНОДАВСТВА
Анотація
У статті розглянуто окремі міжнародні інструменти, які можуть допомогти втілити в Україні антикорупційні ініціативи у сфері публічних закупівель та підвищити прозорість процедур. Показано як досвід Європейського Союзу з регулювання цієї сфери є успішною практикою для України у створенні і регулюванні ринку публічних закупівель. Розглянуто як теорія і практика використання подібних методів і засобів міжнародного антикорупційного права, відображених у статті, формує перспективи подальших розвідок у сфері протидії корупції у сфері публічних закупівель. Доведено, що станом на сьогодні, українське суспільство активно включається в процес створення нормативно-законодавчої бази, що сприяє проведенню чесних та прозорих публічних закупівель, та важливу роль у цьому процесі відіграє імплементація міжнародного законодавства.

ANALYSIS OF THE MANAGEMENT LEGISLATIVE MECHANISM OF THE PUBLIC PROCUREMENT PROCESS IN THE FRAMEWORK OF THE EU LEGISLATION IMPLEMENTATION IN THE FIELD OF PUBLIC PROCUREMENT TO UKRAINIAN LEGISLATION
Summary
The paper discusses some of the international instruments that can help implement anti-corruption initiatives in the field of public procurement and increase the transparency of procedures. One of the directions of state participation in economic turnover is the procurement of goods, works and services for state needs. The high importance of public procurement is due, above all, to their particular focus, since they are needed to meet the needs of the state, ensuring its livelihoods, the fulfillment of its functions by the state. Procurement of products for state needs accounts for a significant proportion of the expenditure part of the different levels budgets, in connection with which the task of efficient spending of allocated funds for this purpose, which can be solved primarily when placing a public order, becomes particularly relevant. The experience of the European Union in regulating this area is almost a thirty-year history of the public procurement market liberalization and over time this market is only expanding, indicating the successful practice of creating and regulating the public procurement market. It seems logical that the theory and practice of using such methods and means of international anti-corruption law as reflected in the article form the prospects for further intelligence in the field of counteraction to corruption in the field of public procurement. As of today, Ukrainian society is actively involved in the process of creating a regulatory and legislative framework that promotes fair and transparent public procurement, and the implementation of international law plays an important role in this process. The Ukrainian government continues to implement measures on European norms in the public procurement system, develops and improves its own developments. In addition, various EU structures support such measures by providing adequate funding and preparing the appropriate information space. Such endeavors already have some positive successes, but the main goal is the introduction of transparency and fairness standards in the public procurement system in Ukraine, which are generally accepted in the EU.
