ІНТЕРЕСИ ДЕРЖАВИ ТА ТЕРИТОРІАЛЬНИХ ГРОМАД НА МІСЦЕВОМУ РІВНІ В УКРАЇНІ: ТЕОРЕТИЧНЕ РОЗУМІННЯ
Анотація
Статтю присвячено узагальненню теоретичних підходів до поняття та змісту інтересів держави та територіальних громад на місцевому рівні в Україні. На основі узагальнення сформульовано авторське розуміння понять "інтереси держави" та "інтереси територіальних громад". Зважаючи на положення актів законодавства, виокремлено види інтересів держави та територіальних громад в Україні. Встановлено, що як інтереси держави, так і територіальних громад стосуються всіх напрямів та сфер суспільного життя, однак їх межі в цих сферах суттєво різняться. Акцентовано увагу на тому, що процеси децентралізації державної влади обумовлюють звуження інтересів держави у соціальній сфері на місцевому рівні, тоді як процеси демократизації розширюють межі інтересів територіальних громад в адміністративно-політичній та економічній сферах на місцевому рівні.

INTERESTS OF THE STATE AND TERRITORIAL COMMUNITIES AT THE LOCAL LEVEL IN UKRAINE: THEORETICAL UNDERSTANDING
Summary
An important scientific task today is the theoretical understanding of the interests of the state and territorial communities at the local level in Ukraine, as well as the status of the subjects of their implementation. This is due to the fact that the state not only assigns the solution of certain issues to territorial communities or bodies formed by them, but also carries out a constant redistribution of powers between local authorities in favor of local self-government. Accordingly, the formulation of the author's approach to the definition of "state interests at the local level" and "interests of local communities at the local level" based on the analysis of theoretical developments on their scientific understanding, as well as grouping of these interests and separation of subjects are their goals of this scientific research. Based on the generalization, the author's definition of the concepts "interests of the state at the local level" as perceived and enshrined in legislation is formulated as the functions and powers of public authorities in relation to local development and "interests of territorial communities at the local level" as perceived and enshrined in legislation or existing in the form of customs or established practice, the tasks of residents of territorial communities, as well as local governments formed by them or the state on local development issues. It is established that both the interests of the state and territorial communities apply to all areas and spheres of public life, but their boundaries in these areas differ significantly. Emphasis is placed on the fact that the processes of decentralization of state power cause a narrowing of the interests of the state in the social sphere at the local level, while the processes of democratization expand the boundaries of the interests of territorial communities in the administrative, political and economic spheres at the local level. The subjects of realization of the interests of the state and territorial communities at the local level in Ukraine include local state administrations and local self-government bodies. It is noted that other public authorities take these interests into account in the process of rule-making and resource provision of administrative-territorial units.
