ЗАРУБІЖНИЙ ДОСВІД МЕХАНІЗМІВ РЕАЛІЗАЦІЇ СОЦІАЛЬНОГО ПАРТНЕРСТВА
Анотація
Досліджено зарубіжний досвід механізмів реалізації соціального партнерства. Зауважено, що відповідно до соціально-економічних та національних особливостей країн у них сформувалися різні моделі соціального партнерства, які відрізняються одна від одної такими ознаками: механізмом правового регулювання договірного процесу, особливостями взаємозв'язків між соціальними партнерами, рівнем демократизації виробничого життя, політичними орієнтаціями соціально-трудових відносин тощо.
Виокремлено різні моделі соціального партнерства: англійську (консервативну), французьку (соціалістичну), німецьку (соціал-демократичну), шведську тощо, які відображають насамперед розвиток економіки, авторитет суб'єктів соціального партнерства і багатогранність умов господарювання й суспільного розвитку, що дає можливість розкрити особливості функціонування соціально-економічної системи ринкового типу та її суспільно-політичного устрою.
Підкреслено, що існуючі в Європі моделі соціального партнерства відрізняються одна від одної організаційним механізмом, нормами і правилами регулювання соціально-трудових відносин, ступенем централізації і децентралізації, процедурами участі у соціальному діалозі, результативністю переговорного процесу та впливом соціального партнерства на соціально-економічний розвиток, але мають і спільні принципи партнерства.
Виокремлено структуру європейського національного соціального партнерства за сферами впливу.
Проаналізовано Європейську практику механізмів залучення громадських організацій до переговорного процесу в сфері соціально-трудових відносин. Перший механізм передбачає, що до складу учасників тристоронніх органів від уряду призначаються незалежні експерти. Другий механізм передбачає, що поза межами сфери соціального партнерства слід краще окреслити та інституціоналізувати міжсекторальне партнерство як загальний діалог між органами державної влади та проміжними органами, що працюють на колективний інтерес.

FOREIGN EXPERIENCE OF MECHANISMS OF SOCIAL PARTNERSHIP IMPLEMENTATION
Summary
The foreign experience of mechanisms of realization of social partnership is investigated. It is noted that in accordance with the socio-economic and national characteristics of countries, they have formed different models of social partnership, which differ from each other by the following features: the mechanism of legal regulation of the contractual process, the relationship between social partners, the level of democratization -labor relations, etc.
There are different models of social partnership: English (conservative), French (socialist), German (social democratic), Swedish, etc., which reflect primarily the development of the economy, the authority of social partnership and the diversity of economic and social development, which allows to reveal features of the functioning of the socio-economic system of the market type and its socio-political system. It is emphasized that the existing models of social partnership in Europe differ from each other by organizational mechanism, norms and rules of regulation of social and labor relations, degree of centralization and decentralization, procedures for participation in social dialogue, effectiveness of the negotiation process and impact of social partnership on socio-economic development. have common principles of partnership.
The structure of the European national social partnership by spheres of influence is singled out.
The European practice of mechanisms of involvement of public organizations in the negotiation process in the field of social and labor relations is analyzed. The first mechanism stipulates that independent experts are appointed by the government to participate in the tripartite bodies. The second mechanism stipulates that, outside the sphere of social partnership, intersectoral partnership should be better defined and institutionalized as a general dialogue between public authorities and intermediate bodies working for the collective interest. The key directions of modernization of social partnership are identified, which are decentralization and development of informal mechanisms of employee participation, the spread of social partnership to the level of enterprises and within firms.
Summarizing the experience of social partnership development on the example of EU member states, new trends in its sphere of influence are highlighted, namely: on the socio-economic and environmental spheres; expanding the subjectivity of social partnerships; reducing the level of centralization of collective bargaining between labor and capital in some countries and coordinating the actions of the social partners; the emergence of institutions designed to deepen and fill new content of social partnership; diversification of employee participation in management decisions; development of so-called "green" jobs and innovative entrepreneurship.
