НОРМАТИВНО-ПРАВОВА БАЗА ОРГАНІЗАЦІЇ НАДАННЯ СОЦІАЛЬНИХ ПОСЛУГ
Анотація
Механізми організації, як сукупність методів взаємоузгодження дій та кроків сторін в процесах надання соціальних послуг, впливають на добробут осіб, що опинились у складних життєвих обставинах. У науковій роботі визначено, що актуальна процедура забезпечення надання соціальної допомоги і підтримки, а також процеси організації соціального обслуговування в Україні побудовані на основі базових аспектів та принципів, уся сукупність яких узагальнена у Конституції України та Законі "Про соціальні послуги". Проте, механізми, методи та інструменти організації допомоги громадянам є недосконалими внаслідок низької ефективності, а також значної мінливості, притаманної законотворчим процесам в Україні; це зумовлює необхідність проведення перманентних досліджень проблематики в контексті вирішення проблем низької ефективності нормативно-правової бази організації надання соціальних послуг в Україні.
Наукова стаття являє собою оригінальне дослідження нормативно-правової бази, що забезпечує роботу механізму організації надання соціальних послуг, а також є основою для ефективної роботи системи соціальної допомоги і підтримки громадян в Україні.
Дослідження проблематики здійснювалось завдяки застосуванню методів порівняння, абстракції, аналізу та узагальнення.
В науковій роботі було детерміновано сутність сучасного механізму організації надання соціальних послуг, допомоги і підтримки осіб, які мають таку потребу, а також роль нормативно-правової бази у практичній реалізації цих процесів. Авторами проаналізовано нормативно-правові документи, які визначають організаційні основи роботи із громадянами в частині надання соціальних послуг, а також проблеми, зумовлені наявністю недосконалостей у законотворчих процесах в Україні. Досліджено зміни нормативно-правового забезпечення, зумовлені реформуванням механізму надання соціальних послуг внаслідок реалізації адміністративної децентралізації.

REGULATORY AND LEGAL BASIS OF THE ORGANIZATION OF PROVISION OF SOCIAL SERVICES
Summary
A general purpose mechanism for organizing as a set of the method of concerted action and steps taken by the authorities, who provide social services has impact on the well-being of citizens, who found themselves in difficult life situations. It is defined that the current ways to ensuring the provision of appropriate social assistance and support, as well approaches to the provision of social services are based on basic aspects and principles; these are outlined in the Constitution of Ukraine and the Ukrainian Law on social services. But methods and tools the provision of social assistance and support are imperfect; this is a consequence of lack effectiveness and the fact that the legislative process in Ukraine is not organized. These aspects acknowledge the relevance of problematic in the context of improving of regulatory and legal support of organization of social services in Ukraine in the long run.
The article is devoted to the analysis of the legal framework as a basis for ensure optimum regulation and practical functioning of the system of social services and enjoyment of individual social rights and social assistance citizens in Ukraine.
Comparison, methods of abstraction, analysis and generalization are the research methods which were used in the article.
In this science paper the essence of the modern mechanism for organizing of social services for the population, approaches to the provision of social assistance and support citizens who daily request its services as well as the importance of legal frameworks in these processes are determined. The set of legislation which lay down the procedure for organizing of social services and the actual problems, including those related to fact that the legislative process in Ukraine is imperfect are identified. The recent changes in the legislative framework which took place as the result of sequencing of administrative decentralization reforms are described in this science paper.
The article investigates that the current legal framework is aimed at optimizing the organization of social services to citizens. The main advantages of the updated Law are: first, increasing the availability of services and transparency of the process of organizing their provision, ensuring the protection of the rights of recipients; secondly, promoting the creation of a national market for social services, supporting the activities of non-governmental organizations; thirdly, improvement of the organization of system management in the conditions of decentralization and optimization of expenses for social service of the citizens which have appeared in SZhO by definition of priority tasks in strategy of the organization of social work; fourth, increasing the targeting of social services; fifth, the development of the practice of applying common approaches in the organization of the social services system. Achieving a high level of targeting of social services was achieved through the coordination of strategy and tactics, as well as legislative support for the provision of social services with the decentralization reform. Due to the formation of the OTG network, additional legal documents regulating the organization of social work on the ground were adopted.
